A responsabilidade médica e a Inteligência Artificial: a reinvenção da Bioética

For many years now, the creation and development of Artificial Intelligence has made it possible to include it in various areas of life, including medicine. With the increased exposure of users to advanced technology, it has become imperative to consider how health professionals should use these new working tools so that, during their professional work, the rights of the user are not compromised and respect is maintained for all the values required by the medical leges artis. Considering the role of Artificial Intelligence in medical liability is not a new issue for the fields of Medicine, Law and Bioethics, but within the academic research bubble, these issues have interestingly evolved. Perhaps we can attribute this new interest in medical liability through the application of Artificial Intelligence to the covid-19 pandemic. With the pandemic, health professionals have been forced to connect with a more digital side of their profession, and it has also made ordinary citizens realize that technology in medicine could go further than a surgical robot. Bioethics, for its part, is not indifferent to issues of medical liability due to the use of Artificial Intelligence and, in this sense, has forced itself to exercise forward-thinking in the future in an attempt to keep up with the rapid pace of technological innovation. These three sciences cooperate so that it is possible to protect health professionals and users in matters of medical liability, where the use of Artificial Intelligence has occurred, however, we will study how technological innovation of this caliber forces the reinvention of Bioethics as we know it.
